On Friday, the government filed an emergency request to the federal top court, seeking approval to station national guard forces to Illinois.

This move is part of a larger campaign to expand the domestic use of the military in several urban centers under Democratic control.

Court Fight Over Guard Activation

In an urgent petition, the US Department of Justice urged the court to reverse a lower court ruling that had blocked the deployment of several hundred state guard personnel to the Chicago region.

The federal judge had voiced concerns about the government's justification for deploying forces, challenging its explanation in given local conditions.

A higher court affirmed the previous order on midweek, leaving the activation on hold while the court case proceeds.

White House's Claims

The solicitor general, speaking on behalf of the government, wrote in the latest petition that government officers have frequently been “intimidated and attacked” in downtown Chicago and the neighboring town of Broadview community.

This area is home to an Immigration and Customs Enforcement detention facility.

The president has earlier deployed state guard forces to the Windy City and Portland, Oregon, following prior sendings to Los Angeles, the city of Memphis, and the nation's capital.

The White House has claimed that troop deployment is required to reduce protests and strengthen border control.

Ideological Opposition

Elected Democrats have vehemently criticized the move, claiming that the administration's assertions are inflated and driven by politics.

They accuse the president of misusing his authority to punish opponents.

The judiciary have also voiced skepticism about the government's portrayal of events.

Local leaders say that demonstrations over ICE activities have been primarily limited and peaceful, challenging the president’s portrayal of “battlefield” circumstances.

Jurisdictional Framework

At the center of the conflict is the president’s use of a national law authorizing the commander-in-chief to nationalize the state guard only in situations of insurrection or when “powerless with the standard military to execute the regulations of the United States”.

The administration maintains that the personnel are required to safeguard US facilities and officers from demonstrators.

Latest Actions

Previously, the administration took control of three hundred troops of the Illinois military reserve and directed extra guard from Texas forces into the state.

As city officials condemned the move, the White House increased his statements, urging the arrest of Chicago’s mayor and the Illinois governor, both Democrats, accusing them of failing to protect immigration officers.

Illinois and municipal government filed a combined lawsuit the government to block the sending.

On 9 October, district Judge April Perry, appointed by Joe Biden, handed down a preliminary order preventing the command.

Simultaneously in the Chicago area, at least eleven people were detained outside the Broadview Ice detention center following serious disputes between state law enforcement and protesters.
